By placing an order on the Sendit.com website, you agree to be bound by Sendit's Terms & Conditions set out below.
The owner of this website is The Hut.com (Trading) Limited, whose address is 17 The Esplanade, First Floor, St Helier, Jersey, JE2 3QA.
Sendit.com is a trading name of The Hut.com (Trading) Limited and in the following terms and conditions the words Sendit.com and/or Sendit.com are used to refer to The Hut.com (Trading) Limited or The Hut.com Limited where applicable and any associated companies, as is appropriate to your specific order.
You undertake that all goods so purchased by you, are for your own private and domestic use only and you accept email as a valid means of communication of any agreement between you and Sendit.com.

Contract for the Supply of Goods

The display of goods on the Sendit.com site amounts to an invitation to treat only and is not an offer to sell goods at any price indicated. No contract for the supply of goods will be deemed to exist between you and Sendit.com unless, and until, an email is sent by Sendit.com to you confirming that your order has been shipped. You must check that the details of your confirmation email are correct as soon as possible and you should print out and keep a copy for your records. This confirmation email amounts to an acceptance by Sendit.com (or 3rd party supplier that is engaged on your behalf by Sendit.com) of your offer to buy goods from Sendit.com and this acceptance is effective regardless of whether or not you receive the email.
Sendit.com are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.
Price and availability information is subject to change without notice.

Site Information

To the fullest extent permitted at law, Sendit.com is providing this site and its contents on an "as is" basis and makes no representations or warranties of any kind with respect to this site or its contents. Sendit.com disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Sendit.com does not represent or warrant that the information accessible via this site is accurate, complete or current.

Processing of orders

Sendit.com aim to ship all in stock items within 24-48 hours* of receiving your order but your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable. We regret we are not able to supply dates when our suppliers may get an item in stock. We will keep you updated by email as to the status of your order (unless you ask us not to) and you can keep track yourself on-line with our Order Tracking page. Please note that your order may be sent to you in installments.
Credit and debit cards are debited before items are shipped by Sendit.com. Orders with a delivery address within the UK and of a value of £15.00 or less are not subject to VAT. Orders with a delivery address within the UK and of a value over £15.00 are subject to VAT.
Shipments to your delivery address may be subject to import duties and taxes which are levied once a shipment reaches your country. Any such additional charges to clear customs must be borne by you. You should note that customs policies vary widely from country to country so we advise that customers contact their local customs office for further information. Note that international shipments are subject to opening and inspection by customs authorities.
Our Returns Policy applies to all purchases from Sendit.com.
* Monday-Friday. Not applicable over weekend hours.

Delivery

We deliver to addresses both inside the UK and outside the UK with the exception of Russia and Brazil.

We reserve the right to withdraw this offer at any time. If we do decide to charge you for delivery, we will let you know as soon as possible and give you the option of reconfirming your order at the new price including delivery or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund.

Please see our help section in order to find out more about arrangements for delivery. We will use all reasonable endeavours to adhere to the delivery times set out in that section and though we believe that we have aligned ourselves with excellent delivery partners, there may be times when parcels are delayed.

If an item has been lost in transit, we may not despatch a replacement item immediately. Resent or Replacement items will be despatched at our discretion or subject to availability, once all tracking and investigative avenues have been exhausted. This may include waiting up to 30-45 days from despatch for undelivered mail to be returned to us, depending on the delivery country.

All non-delivery claims must be received within 45 days of our original shipment date to you.

Limitation of Liability

This liability section applies only to the extent permitted by law.
Except as set out below, neither Sendit.com nor any of their directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site.
Sendit.com does not limit its liability for death or personal injury to the extent only that it arises as a result of negligence of Sendit.com, its directors, employees or other representatives.
Sendit.com does not accept liability (except as set out below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Sendit.com shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund you the amount you paid for the goods in question PROVIDED THAT you notify Sendit.com of the problem by contacting us within 7 days of delivery of the goods.
Sendit.com does not accept liabilty for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use of the Sendit.com website or for any products purchased from the Sendit.com website. Sendit.com will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.

Illegal Acts

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic 'fingerprints' of every order placed on Sendit.com to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

Inactive Accounts / Unused Credit

Sendit.com reserves the right to close inactive accounts and remove any unused credit, if applicable, from these accounts. Unused credit will expire twelve months after the credit has been issued. Additional credit applied to an account will commence another twelve month period before the credit will expire. This includes the previous remaining credit. Expired credits on closed accounts will not be refunded.

Modification of Terms

Sendit.com reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Sendit.com site. These terms and conditions will apply to your order once you have received your confirmation email. They will supercede any other terms and conditions in whatever form given. Please print and retain a copy of the terms and conditions once you have received your confirmation email.

Chocolate & Sweets

To make the most of your sweets we recommend that they are consumed within 12 weeks of receipt.

All products are individually dated to ensure the products are consumed when they are at the best.

Nut content

Customers should be aware that all our sweets are manufactured and packaged in environments in which nuts may be present and therefore cannot guarantee that any sweets supplied are free of nuts and nut traces. Please note that ingredients provided are those from manufacturers' packaging and lists and are therefore as accurate as those available from sweet manufacturers, we therefore cannot be held responsible for their content.

Returns

In order to ensure our customers receive the best level of service and are happy to indulge their sweet tooth we offer a comprehensive returns policy in the unlikely event that you are not 100% satisfied with sweets delivered. Please note that the following returns procedure must be followed, and failure to do so may result in us being unable to exchange goods or provide refunds. Also please be aware that we cannot be held responsible and provide refunds/exchanges on stock affected by circumstances beyond our control. This includes damage and neglect after goods are received, goods being stored in climatic conditions such as extremes of temperature that can affect some items - items often stick together or alter appearance slightly, but will taste the same and damage by third parties. In addition please be aware that during the hot summer months goods in transport can be effected by the heat so be aware that delicate items such as chocolate may not always look as intended, but they will of course still taste as good as ever.

Should you wish to return an item for any reason please notify us within 48 hours of receipt of your order of any part that is unsatisfactory. In order to arrange a return, please contact us and inform our customer service team of your order number, the item you are returning and the reason for the return.

We will then reply with a unique returns authorisation number and the address you need to send the item to.

You'll need to package the item securely and include:

  • Your order number
  • The returns authorisation number
  • Whether a replacement or refund is needed
  • The reason why you are returning the item.

Goods returned should be in their original condition and packaging in which they arrived, along with a copy of the invoice or packing slip.

Once received items will be checked and refunds on goods and postage arranged where suitable. We cannot issue refunds on simply unwanted goods due the perishable nature of goods on sale. Refunds/exchanges will only be offered on items that are faulty, and were clearly so at the time at which they were dispatched.

If you submit a review, you grant Sendit.com a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You grant Sendit.com and its sublicensees the right to use the name that you submit in connection with such content, if they choose.

You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

You agree to perform all further acts necessary to perfect any of the above rights granted by you to Sendit.com, including the execution of deeds and documents, at the request of Sendit.com.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Sendit.com:

  1. The content and material is accurate;
  2. Use of the content and material you supply does not breach any applicable Sendit.com guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Sendit.com for all claims brought by a third party against Sendit.com arising out of or in connection with a breach of any of these warranties.

Winners of the review competition will be notified by email. Failure to respond to our notification email within 20 days will result in the prize being forfeit.

Where any goods are returned (except for an exchange where products are faulty/defective), we are entitled to either require the return of all goods delivered as part of that Multibuy offer at your cost or charge you for the goods retained by you at the full price quoted on this site.
